The key idea behind the energy efficiency obligation scheme is that obligated parties must introduce programmes and implement measures that result in certified energy savings for the end-users.

 Obligated parties

An electricity and natural gas trading and universal service provider license holder under the Electricity Actand the Gas Supply Act, a party supplying natural gas under a contract to a user acting on its own behalf, as well as an economic operator selling transport fuel to end-users, including for own use (hereinafter collectively: obligated party)

a) in 2021, must achieve annual energy savings equivalent to 0.05% of the quantity of energy subject to obligation sold by it to end-users in Hungary in 2019,

b) in 2022, must achieve annual energy savings equivalent to 0.1% of the quantity of energy subject to obligation sold by it to end-users in Hungary in 2020,

c) in 2023, must achieve annual energy savings equivalent to 0.3% of the quantity of energy subject to obligation sold by it to end-users in Hungary in 2021,

d) in 2024, must achieve annual energy savings equivalent to 0.5% of the quantity of energy subject to obligation sold by it to end-users in Hungary in 2022,

e) in the 2025-2026 period, must achieve annual energy savings equivalent to 1.4% of the quantity of energy subject to obligation sold by it to end-users in Hungary in the second year preceding each year,

f) in 2027, must achieve annual energy savings equivalent to 1% of the quantity of energy subject to obligation sold by it to end-users in Hungary in the second year preceding each year,

g) in the 2028 -2035 must achieve annual energy savings equivalent to 0.5% of the quantity of energy subject to obligation sold by it to end-users in Hungary in the second year preceding each year,

The Authority determines, in a resolution, the amount of energy savings due for each obligated party for the current year by 30 November of the previous year. Obligated parties can obtain information about their current and previous years’ energy saving obligations after logging in at https://ekr.mekh.hu.

The obligated party may fulfil its energy saving obligation either through energy efficiency investments or energy efficiency improvement measures carried out within its own activities or in another sector outside its activities, as well as through certified energy savings achieved by other obligated parties, energy efficiency service providers not qualifying as obligated parties, or other third parties. In the case of an energy efficiency improvement measure implemented by another party, the obligated party may obtain the certified energy savings through a bilateral agreement or on an organised market.

The obligated party may collect the certified energy savings intended to be accounted for a given year in the EEOS Data Collection System until 31 March of the year following the current year, in the manner and with the data content specified in HEPURA Decree No. 17/2020. (XII. 21.).

If the obligated party does not achieve the prescribed energy saving obligation for a given year, by 31 March of the following year it must declare whether it will fulfil its obligation in one of the next two years or may choose to substitute its saving obligation by paying an energy efficiency contribution. The amount of this contribution is HUF 50,000 for each 1 GJ/year not fulfilled. If the obligation is not fulfilled by the deadline, or if the obligation is fulfilled with energy efficiency measures not in accordance with the composition specified in the Energy Efficiency Act, the Authority shall impose a fine of HUF 70,000/GJ.
