According to Section 17/b of Chapter VII of the Energy Efficiency Act, an economic operator with final energy consumption as defined in the Implementing Decree of the Energy Efficiency Act must engage at least one energy specialist consultant who is independent from it in terms of employment and company law. The task of the energy specialist consultant is to promote the adoption of an energy efficiency mindset and energyefficient behavioural patterns in the operation and decision-making of the economic operator required to engage them.
According to Section 7/A(1) of the Implementing Decree of the Energy Efficiency Act, an economic operator is required to engage an energy specialist consultant if, in the three years preceding the current year, the average of its annual energy consumption exceeds any of the following values
a) 400,000 kWh of electricity
b) 100,000 m3 of natural gas
c) 3,400 GJ of heat
For the purposes of Subsection (1), energy passed on without metering is considered as consumption by the party passing it on. For example, if in an office building electricity is distributed based on area, it is counted as the consumption of the lessor; if measured with certified sub-meters, it is counted as the consumption of the lessee.
An energy specialist consultant may be a natural person or an economic operator; their professional eligibility and registration are governed by Section 21/B, and the scope of their tasks is set out in Government Decree No. 122/2015.
